Partner Visa (Onshore/Offshore)

There are 3 types of Marriage for Partner category visas:

  • Legal Marriage
  • De facto Relationship
  • Prospective Marriage

Partner Visa application for Legal Marriage and De Facto Relationship is a two-stage process:

Stage One:  Temporary Partner Visa (Offshore Visa subclass 309/ Onshore Visa subclass 820)
Stage Two:  Permanent Partner Visa (Offshore Visa subclass 100/ Onshore Visa subclass 801)

This visa allows the spouse or de facto partner of an Australian citizen, permanent resident or eligible New Zealand citizen to live in Australia.

Partner of the applicant must be one of the following:

  • An Australian citizen.
  • An Australian permanent resident.
  • An eligible New Zealand citizen.

The relationship must be genuine and ongoing. The applicant and the partner must live together, if they do not, any separation must be only temporary and both parties must freely consent to the relationship.

The applicant must also be older than 18 years of age and not be related to the partner by family means the applicant cannot be an ancestor or descendant of the partner, or have a parent in common.

The application is processed in two stages, about two years apart. The first stage grants a temporary visa and the second stage grant a permanent visa. However, a single application is lodged for both the temporary and permanent visas, and a single application fee is charged.

Prospective Marriage:  This visa allows you to enter Australia and marry your partner within a nine-month validity period. Your partner must be one of the following.

  • An Australian citizen.
  • An Australian permanent resident.
  • An eligible New Zealand citizen.

Parent Visa

This visa allows parents live temporarily / permanently in Australia if their child is an Australian citizen, permanent resident or eligible New Zealand citizen who is settled in Australia.

Eligibility to apply for a parent category visa is:

  • Parents have at least half of their children living in Australia (permanent residents or citizens)living in Australia lawfully for at least 2 years before the applicant lodges the visa application.
  • Balance of family test criteria requirements should be fulfilled.
  • The applicant meets health and character requirements.

Visitor Visa

Visitor visa (subclass 600) allows the visa holder to travel to Australia for a short duration for the intended purpose such as recreation, visit an Australian resident family member, medical treatment, business activities.

  • The duration of visit can be for up to 3, 6 or 12 months.This visa can be granted for up to 5 years multiple travel (Maximum stay of 1 year during each visit) depending on the nature of the visit.
  • The base application charge for this visa may vary depending upon the category and location of the applicant.
  • This visa can be applied from inside and outside Australia.
  • As per the the visa grant letter, the visa holder will be allowed travel to and from Australia on single or multiple occasions until the visa is valid.

Every person who intends to travel to Australia as a visitor must apply for an individual visa application.
